and legitimacy to do so. It also stimulates a reflection about the
conditions for rebalancing content control, which is essential to a

            <summary type="html"><![CDATA[Le 13 mai 2022, la CNPD a lancé GDPR-CARPA en tant que premier
mécanisme de certification sous le GDPR. Il s’agit d’un outil de
responsabilisation volontaire conçu pour aider les responsables du
traitement et les sous-traitants luxembourgeois à démontrer la
conformité d’une activité de traitement au regard du RGPD. Les
candidats à la certification RGPD-CARPA doivent s’assurer que les
opérations de traitement concernées répondent aux critères de
certification de la CNPD, ce qui implique notamment la désignation
d’un délégué à la protection des données et la mise en place d’un
certain nombre de politiques et procédures. Des organismes de
certification spécifiquement agréés évalueront la demande sur base
d’une «&#160;assurance raisonnable&#160;» et accorderont la
certification pour une période maximale de trois ans. La
participation au GDPR-CARPA, cependant, s’annonce être un
investissement considérable en termes de temps et de ressources.
Alors que certaines organisations peuvent considérer que la
participation vaut l’investissement, par exemple, parce qu’elles
sont régulièrement sollicitées par des partenaires contractuels
pour démontrer leur conformité ou ont besoin d’assurance concernant
une activité de traitement spécifique à haut risque, d’autres
peuvent la considérer comme trop coûteuse. Finalement, seul le
temps dira si GDPR-CARPA sera un succès.]]></summary>

            <summary type="html"><![CDATA[Even criminal law is affected by the phenomenon of globalization of
law.It goes far beyond the traditional field of international
criminal law which is based on a foreign element and even on a
purely international source of law such as international crimes.The
emergence of an independent international business criminal law
shares some common roots with criminal law itself, but also has
distinct and strong specificities&#160;: among other things the
prudent management process and the anticipation of legal risk which
derive from the compliance rules. Compliance entails a systemic
conception of law based on the notion of effectiveness and
co-regulation, remote from the traditional concepts of criminal
law. Yet it intertwines with criminal law in many instances.This
study will aim at identifying and analyzing these overlapping
contacts.First, from the standpoint of the rules applicable to
traditional criminal violations that put the States and the
international community in a major systemic risky position such as
money laundering, corruption, tax evasion, tax fraud and
environmental crimes.Second, from the standpoint of the soft law
rules and its attached sanctions whose lack of predictability is
paradoxically a source of possible insecurity for the States as
well as for the private sector.]]></summary>

the world. This new instrument makes it possible to delegate, by
compulsion, the prevention and detection of infringing behaviour to
large companies. The stakes of compliance are numerous: to fight
against infringement behaviours, to improve corporate governance,
and to reduce sanctions and fines. In this article, we will study
the role played by the US Department of Justice in structuring
compliance. Recently, this structuring has evolved with the
adoption of the Deputy Attorney General Lisa Monaco Memorandum.
This text presents the new orientations that DOJ agents are invited
to apply for the next few years. The purpose of this article is to
provide the reader with an operational commentary on the reforms
brought about by this new memorandum. As such, it aims to separate
the risks and opportunities that this new text will inevitably
generate.]]></summary>

            <summary type="html"><![CDATA[In the face of the climate emergency, corporate responsibility is
being stepped up by means of compliance. The latter is becoming
increasingly closely linked to environmental criminal law. Designed
primarily as an ex ante liability mechanism – i.e. prior to any
offence – compliance is primarily a preventive complement to
criminal law. In this respect, criminal law "outsources" its
preventive purpose to the benefit of compliance. Indeed, the
internationalisation of mechanisms by companies constitutes a means
of making environmental criminal law effective. Compliance, in the
form of ex post liability – after the offence – is a highly
effective tool that replaces failing criminal law. Sometimes, the
quest for effectiveness is achieved at the expense of the
fundamental principles of criminal law in the event that compliance
interferes with criminal law.]]></summary>
