based on open and decentralized blockchains. If it were to

political and geopolitical consequences. The increasing use of
cryptocurrencies could challenge the current monetary paradigm and
the financing model of modern welfare states. Cryptocurrency
projects promoted by large companies or central banks are part of

The new focus on the commons in juridical thought is explicitly
grounded on a reaction against the logic of private appropriation,
and in particular against the « absolute » power it gives
to the owner over his thing (as stated in the Article 544 of the
French Code Civil). But is this « absolute » character an
essential and intrinsic feature of private property ? And what
is the origin of this « absolute » that came to be
characteristic of private property ? This article seeks to
answer these questions by examining the origins of private property
(and of its « absolute ») both in Roman law – from which
everything started – and in the works of the founding father of
English liberalism, John Locke, from which everything started again
for the Modern legislators. As distant as these two universes may
be, they have in common the need to be returned to their original
context, exhumed under the fossilized interpretations they
engendered. Because their exegeses were always more inclined to
analyse roman and modern conceptions of private property as
anticipations of their own conceptions, they too often blurred how
distinct those conceptions were. They occulted how they both
constitute the locus of an original reflection on property (as a
technique, and as the condition of the right to resist) that
continues to shape our representation of property, but only through
numerous mediations. The first and the second parts of the article
therefore aim to examine the invention of private property in
context, respectively in Roman law and in English modernity, in the
so influential writings of Locke. In the third section, the authors
build on the reconstructions offered earlier in order to confront
the Roman and Modern geneses of private property rights. The aim of
this prospective and exploratory analysis is to understand how the
type of relations men should entertain to things are
« inferred » from a general conception of the world that
determines property relations. The analysis insists on the
irreconcilable differences existing between the Roman and the
Modern imaginaries, and on how those differences implied major
transformations of the very concept of private property from its
Roman origins to its contemporary meaning. By examining seven
« contrasts », the authors seek to problematize the
reflection on the commons by renewing our understanding of private
property.

Can transhumanism escape libertarianism? The case of James
HuguesTheorized by James Hugues in Citizen Cyborg (2004),
technoprogressism seeks a third way, between libertarian
transhumanism and critical bioconservatism. It shares with the
first the fascination for the technique, the faith in the progress
and the claim of the absolute individual freedom: each one has the
right to transform itself and its children, as he wants, except if
it directly affects others. Technoprogressism shares with the
second the fears of a biotechnological inequality aggravating
social disparities, and pleads for control by national and
international state authorities. Hugues thus dreams of a
transhumanism for the good of all, thanks to the moral improvement
of each one. Is such a middle way between individual freedom and
state control possible? We propose to show the strengths and the
weaknesses of this social transhumanism.
